I advise all types of key stakeholders in an insolvency or restructuring:  shareholders, lenders, directors and creditors in relation to distressed debt/insolvency situations. I act in particular for:

  • banks and other financial institutions in respect of security enhancement and enforcement of security rights;
  • insolvency practitioners in relation to business and asset disposals and pre-insolvency advice;
  • directors in respect of their duties and obligations in stressed and distressed situations;
  • purchasers of businesses and assets in stressed and distressed situations; and
  • both corporates and insolvency practitioners in respect of CVAs and restructuring plans.

Experience

  • Acted for the board and insolvency practitioners in relation to a nationwide hardware and retail group.
  • Advised the board pre-insolvency in relation to a potential restructuring and subsequently the administrators of a multimillion pound a North Sea oil and gas exploration company.
  • Advised the multinational companies in respect of a $1bn restructuring in a liquidation process in the Middle East.
  • Advised the purchaser of Harland and Wolff shipyards in the sale out of an administration process.
  • Acted for the largest creditor on the special administration of a UK based, FCA authorised and regulated finance broker. in respect of the proposal of a restructuring plan.

What others say…

I worked with Michelle on a property insolvency requiring significant legal input. Michelle’s experience meant she was able to provide commercial and practical insolvency advice that focused on a clear path to providing a solution for me and ultimately the company’s creditors. Michelle’s experience is difficult to find elsewhere in the Restructuring legal market.
